Okay, here goes. Another way of looking at the
imported Gitmo Tali-banners / John Lind Walker
situation, it seems to me, is to assume the obverse
(although ridiculously remote) possibility.

Suppose the Taliban , who were at the time the ruling
power in Afghanistan, had prevailed over the US in a
battle on US soil. And imagine further that they then
scooped up selected US governmental leaders and
military personnel and had flown them back to a prison
camp at a military base of theirs on an island just
off Pakistan, and held them there pending summary
trial by a Moslem religious council under that body's
rules and procedures.

Add the fact that what they were being accused of was
violating the laws of Taliban-ruled Afghanistan - not
any US statutes. Like maybe death penalty punishable
adultery for some of the congressmen, and beating and
stoning for female US military personnel who didn't
wear the required veil and gunny sack in public during
the conflict.

Their arguement would be, of course, they were at war
with a country that had sent cruise missles reigning
down on them launched from offshore US submarines a
few years before. The US troops they took back to
Afghanistan would be charged with conspiracy to
commit terrorist acts - while the Taliban continued to
hunt down a fleeing Prez Dubyah and Mullah Chaney in
the Piney Woods of East Texas.
